CO-MAKING USER POLICIES

M.Y. Crafts × Orée Studio

These User Policies apply to all users of the co-making studio at Siezenheimerstraße 41, 5020 Salzburg.

By booking a co-making session or membership through our website, you confirm that you have read and accepted these User Policies and agree to follow the studio rules.

The formal user agreement will be provided to you separately after booking.

§ 1 Object and purpose of use

1.1 The landlord, as the subtenant of the studio located in 5020 Salzburg, Siezenheimerstraße 41 (“Panzerhalle”), is entitled the sublease and pass on rights of use in accordance with the sublease agreement concluded verbally with Philip Yiu Chong Yuen and with his consent.

1.2 The landlord rents to the tenant and the tenant rents from the landlord a pottery space (consisting of a pottery wheel, table and chair) in the m.Y CRAFTS studio at Siezenheimerstraße 41 in 5020 Salzburg (“Panzerhalle”).

1.3 The tenant is entitled to use the shared facilities of the studio (including tea kitchen, sanitary facilities and lounge area). The tenant is obliged to take the interests of the other tenants into account and to comply with the landlord's requests.

1.4 The rental item may only be used to carry out pottery work. The tenant is not entitled to register a company headquarters at the address of the object of use or similar.

1.5 The landlord must be informed immediately of any changes to the tenant's name, company, legal form, corporate purpose or sales tax liability. Until a new address is announced in writing, deliveries to the old address are considered legally effective.

1.6 The tenant inspected the pottery site before signing the contract and found it suitable.

§ 2 Start of use, duration of use, handover

2.1. The usage relationship begins upon commencement of the agreed subscription and continues for the agreed subscription period. It expires automatically at the end of the agreed subscription period without the need for separate termination.

The usage relationship is agreed on an hourly rate (16€/h) and is valid until revoked.

2.2. At the start of the tenancy agreement, the tenant will receive a pottery wheel from the landlord.

2.3. If the tenant defaults on payment, the landlord is entitled to terminate the usage relationship with immediate effect.

§ 3 Usage fee, additional services

3.1. The monthly usage fee per pottery place according to 1.2. is EUR plus 20% VAT

This amount includes:

- a pottery place consisting of a potter's wheel, work table and chair

- the proportional operating and additional costs

- the proportional costs for electricity

3.2. The agreed usage fee will be invoiced to the tenant in advance by the landlord and will be credited to the account shown on the invoice immediately upon receipt of the invoice o be transferred or paid directly online via the landlord's homepage when the booking is completed.

3.1. In the event of default, the tenant is obliged to pay the statutory interest pursuant to Section 456 UGB/4% default interest payable p.a. from the due date to the landlord.

§ 4 Use by the tenant

4.1. The rental is exclusively for the use of the rental item for pottery purposes.

4.2. The tenant is prohibited from passing on the item of use or otherwise transferring the right of use to third parties (for a fee or free of charge).

4.3. Structural changes and other changes (e.g. moving the pottery area) to the property may not be made.

4.4. The tenant undertakes to treat the object of use with care. Any damage beyond normal wear and tear must be compensated. The tenant must report any damage to the object of use to the landlord immediately after becoming aware of it.

4.5. The tenant, not the landlord, is personally liable for damage to items brought in by the tenant or their loss caused by other tenants, third parties or due to other circumstances.

4.6. Access to the rental property is generally permitted at any time. A key is stored in a key safe for access to the studio. The associated code will be given to the tenant upon handover. The tenant is expressly prohibited from passing on the code to third parties and is liable for any damage caused by the landlord passing it on. The tenant is also liable in the event of loss if the key is removed from the key safe.

4.7. Access to the studio is only permitted to the tenant.

4.8. The tenant undertakes to comply with the house rules posted in the studio, which form part of this contract.

§ 5 Obligations of the tenant upon termination of the usage agreement

After termination of the usage agreement, the item of use must be returned to the landlord in the same good condition, otherwise cleared and cleaned taking normal wear and tear into account.

§ 6 Final provisions

6.1. No oral additional agreements were made; changes or additions to this user agreement must be made in writing.

6.2. Austrian law applies to this contractual relationship. In the event of disputes arising from this contractual relationship, the domestic (Austrian) jurisdiction and the local jurisdiction of the relevant court in 5020 Salzburg-Stadt are agreed.

6.3. This user agreement is drawn up in two copies, one of which is received by each contracting party.

The landlord has installed video cameras as a security measure and to protect against theft. By signing, the tenant confirms that she is aware that the studio is under video surveillance to the extent permitted by law and that video recordings can therefore be made of her using the property.

Studio mY crafts × Orée Studio house rules

For a good community and smooth co-working experience, mutual consideration

and some generally applicable rules are required.

By signing the user agreement, you are obliged to comply with these house rules,

which are part of the user agreement. There are individual consequences for

violations.

1. Introduction

a.) Please bring an official photo ID with you at the introductory appointment. We only use your data for administrative purposes and do not pass it on to third parties.

b.) You can use our WiFi. You will receive the name and password on the introductory date. The WiFi access data may not be passed on to third parties. It is forbidden to access and/or distribute illegal or unlawful content.

c.) Please be considerate towards other tenants.

2. Security

a.) The last person who is in the premises is obliged to securely lock the back entrance, the glass door to the studio, the intermediate door in the hallway and the main entrance when leaving. The key must then be locked again in the key box next to the main entrance.

b.) The storage room marked “Entry for authorized personnel only” may only be entered with the consent of the authorized persons (Miriam Yuen, Philip Yuen, Roxane Franc).

c.) Two surveillance cameras have been installed for your security. The recordings will only be viewed in exceptional cases.

d.) The windows must be kept closed in the cold season.

e.) Escape routes must be kept clear. This affects the entire entrance area, including the hallway and back entrance.

f.) Kitchen: After using the induction plate, please unplug it from the power supply.

g.) We assume no liability for your personal valuables. Please take them with you when you leave the studio.

h.) Entering the upper floor is at your own risk.

3. Stay/Use:

a.) Only the tenant is permitted to stay and use the areas included in the usage contract. Taking strangers with you is not permitted.

b.) Sign your name on the attendance list when you come and go.

c.) Only use objects, glazes and tools marked with “Co-making” or items that were shown during introduction.

d.) Leave your workplace clean and tidy. All equipment, tools and surfaces used must be wiped with a damp cloth. Please put all used items away properly.

e.) Electrical devices (pottery wheel, lamps, radio, etc.) must be switched off before leaving the studio.

f.) Use only the marked shelf areas to store your pottery.

g.) Smoking is strictly prohibited throughout the building. You are welcome to smoke on our garden terrace behind the house. To do this, please use the ashtray provided. Please empty it yourself.

h.) The toilets in the hallway can be used freely. Please leave them neatly.

i.) You are welcome to bring housetrained and friendly pets with you. You are responsible for ensuring that they do not disturb other tenants.

j.) The tea kitchen is equipped with dishes and cutlery. Please wash all used items yourself. The induction plate and the refrigerator with freezer compartment can be used freely. Please clearly mark your personal items in the refrigerator by name and discard any spoiled food.

k.) Waste separation is very important to us. Please dispose of your waste in the designated bins: general waste, paper, plastic.

4. Other:

a.) You can buy coffee in the kitchen for €1.50 per coffee tab. Sugar and coffee cream are available for free.

b.) We offer you a changing range of drinks. Please help yourself to the marked area in the refrigerator. You can find the prices on the outside of the refrigerator.

c.) Summer special: There are different flavors of ice cream on a stick. Please help yourself to the freezer compartment. You can find the prices on the outside of the refrigerator.

d.) We place great value on mutual trust. This applies to billing (coffee, drinks, ice cream), adherence to the booked times and to each other.
